Article 2 – PURPOSE
The purpose of these ToS is to define the terms and conditions of the Services provided by the Site to the User.
Article 3 – PRE-CONTRACTUAL INFORMATION
The User acknowledges having received, prior to using the Site and in a legible and comprehensible manner, these ToS and all the information required by Article L221-5 of the French Consumer Code (Code de la consommation).
The following information is thus provided to the User in a clear and comprehensible manner:
- –the essential characteristics of the Site;
- –the price and ancillary costs of using the Site;
- –information relating to the identity of the Service Provider, its postal, telephone and electronic contact details and its activities;
- –information relating to the legal guarantees, the functionalities of the digital content and, where applicable, its interoperability, and the existence and terms of implementation of guarantees and other contractual conditions.
Article 4 – CONTRACTUAL DOCUMENTS
Any User who wishes to benefit from the Services provided by the Site by creating an Account expressly accepts these ToS.
The ToS consist of the following contractual documents, listed in descending order of legal precedence:
- –this document;
- –the annexes to this document.
In the event of any conflict between one or more provisions contained in any of these documents, the higher-ranking document shall prevail.
The Publisher reserves the right to derogate from certain clauses of the ToS by establishing special conditions, which will be submitted to the User for prior approval.
Article 5 – DESCRIPTION OF THE SERVICES
The Services offered by the Site consist in facilitating the management of the occupancy of Houses. The Site is not a property rental website.
The first House created by a User is accessible free of charge within the limits set out herein. Any additional House, or any use including Premium Features, requires a Subscription to be taken out in accordance with the pricing displayed on the Site.
The Services allow the Customer to register Houses and to create a network of Users of those Houses (the Groups). The Customer is solely responsible for managing the members of their Group.
Customers may register Houses by taking out a paid subscription (hereinafter the “Subscription”), and thereby allow the Users in their Group to access, for each House, the following features:
- –Calendar for managing bookings / events, together with booking statistics,
- –Inventory management for the House, i.e. the ability to take an inventory, on a declarative basis, of food and non-food products located in the House,
- –Shopping list system, an export of which can be shared outside the Site,
- –Notes system facilitating the sharing of information and documents between Users of a House,
- –Directory of useful contacts for the House (service providers, repairers, etc.)
- –System for tracking the finances of each House, with expenses and income recorded manually by the User,
- –System for tracking the electricity consumption of each House (under the conditions described below),
- –Creation of task lists and assignment of tasks to the Users of the House.
Certain advanced House management features, including in particular the ability to add several administrators, may be reserved for Users holding a Subscription.
Electricity consumption tracking
Electricity consumption tracking is only possible for Houses equipped with a Linky smart meter (Enedis, the French electricity distribution network operator) and for which the User has explicitly given consent to Enedis authorising the Site to retrieve the consumption data. The amounts displayed are provided for the User's information only and cannot be used to claim any sum owed from other Users via the Site.
Price per night
The price-per-night feature, accessible in particular via the calendar, is provided for the User's information only and cannot be used to claim any sum owed from other Users via the Site.
Certain features, in particular those requiring external integrations, extended storage, a significant technical load or intensive use of the Services, may be subject to limitations in the context of a Free House or be reserved for Users holding a Subscription.
The Publisher reserves the right to verify that the creation or management of several Houses by the same group of Users is not intended to circumvent the applicable pricing rules. In the event of legitimate suspicion of circumvention, the Publisher may limit, suspend or restrict access to the Services for the House(s) concerned, in particular by temporarily placing the House in read-only mode, until the Subscription has been regularised.
Certain data made available by the Site, in particular product information obtained when scanning barcodes, comes from external databases. The Publisher does not guarantee the accuracy or completeness of such data and cannot be held liable for any error or inaccuracy originating from third-party services.
Certain features rely on integrations with third-party services. Their availability depends on the proper functioning of those external services, over which the Publisher has no control. The Publisher cannot be held liable for any interruption, limitation or error resulting from such third-party services.
All information and data recorded on the Site for each House are the sole responsibility of the Users, which the Users accept and acknowledge.
Article 6 – ACCOUNT CREATION
To access the Site and benefit from the Services, every User must first create an Account using their email address and a password of their choosing. Any User may create a House and invite other people to create their own Account in order to join it. The administrators of a House are responsible for managing the members they invite to it.
6.1. Founding Administrator
The User who creates a House automatically becomes its Founding Administrator.
The Founding Administrator has the same rights as any administrator of the House, subject to the limitations set out herein, and enjoys a special status guaranteeing continuity in the management of the House and, where applicable, of the associated Subscription.
Only the Founding Administrator can delete the House; the other administrators cannot.
The Founding Administrator cannot be removed from the House by any User. Nor can they leave the House they created: if they wish to leave, they must ask the Publisher to transfer this role to another User of the House, in accordance with Article 6.2.
If the Founding Administrator deletes their Account, the House continues to operate for its other Users; it can then no longer be deleted by a User, and any operation concerning the House itself must be requested from the Publisher.
6.2. Transfer of the Founding Administrator role
The Founding Administrator role may only be transferred by the Publisher, upon a request sent to contact@cazmate.com, to another User of the House who expressly accepts the transfer.
The transfer relates exclusively to the management of the House: it has no effect on ongoing Subscriptions, which remain attached to the House and to the User who took them out.
This transfer is final, unless the Publisher decides otherwise on an exceptional basis.
6.3. General rules
The User is responsible for, and warrants, the truthfulness and accuracy of the information they provide when creating their Account.
The User undertakes to keep their access credentials personal and confidential. The Service Provider cannot be held liable in the event of loss or theft of access credentials. The User must inform the Publisher without delay in the event of any compromise.
A confirmation email will be sent when the Account is created.
The User declares that they have full legal capacity to enter into commitments under these ToS.
Registration is strictly personal to each User.
In the event of a breach by the User of any of the provisions hereof, the Publisher reserves the right to terminate that User's Account without notice.
Article 7 – SUBSCRIPTIONS
The Services provided by the Site are available on a subscription basis under the conditions defined below. The full list of Premium features is available on the Site's Pricing page.
The first House created by a User is accessible free of charge within the limits set out herein and subject to the functional restrictions displayed on the Site.
Any additional House, or any use including Premium Features, requires a Subscription, in accordance with the pricing displayed on the Site.
Subscriptions are taken out and managed from the customer area accessible via the Site or from the mobile application, by payment card or by in-app purchase via the App Store (Apple) or Google Play (Google).
Any User who is a member of a House may take out a Subscription for that House. A Subscription covers the House and all its Users, regardless of which User took it out.
Premium Features include, without limitation:
- –the creation or management of additional Houses;
- –certain external integrations or synchronisations requiring third-party services;
- –certain operations requiring intensive storage or processing;
- –the use of barcode scanning beyond the free quota defined on the Site.
Any feature identified as Premium in the Site's interface requires a Subscription, even when it appears in a Free House.
The limitations applicable to the Free House, as well as the conditions triggering the need for a Subscription, are specified on the Site. Exceeding them obliges the Customer to take out a Subscription in order to continue to have full access to the Services.
When a House becomes subject to a Subscription, its Users retain read-only access to it until a Subscription is taken out by one of the House's Users.
A User wishing to take out a Subscription may pay for an annual Subscription.
The Subscription is concluded by the Customer at the time of payment, subject to their acceptance of these ToS by ticking the corresponding box.
Communications and invoices are archived by the Publisher on a reliable and durable medium so as to constitute a faithful and durable copy. These communications and invoices may be produced as evidence of the contract entered into between the Parties.
The contractual information relating to the Subscription (including in particular the order number) will be confirmed by email. The Publisher strongly advises the Customer to print and/or archive this order confirmation on a reliable and durable medium as evidence. A digital invoice is made available to the Customer in the “my account” area.
Any email sent to the Customer in connection with a Subscription order will be sent to the email address that the Customer uses to log in to their Account.
The Publisher reserves the right not to validate the User's Subscription for any legitimate reason, in particular where:
- –the User does not comply with the ToS in force at the time of their order;
- –the User's order history shows that sums remain due in respect of previous orders;
- –one of the User's previous orders is the subject of a dispute currently being dealt with;
- –the User has not responded to a request to confirm their order sent to them by the Publisher.
The Publisher archives orders in accordance with applicable law. Upon request sent to the following address contact@cazmate.com, the Publisher will provide the Customer with a copy of the order to which the request relates.
Any modification of an order by the Customer after it has been paid for is subject to the Publisher's agreement.
Article 8 – REFERRAL PROGRAMME
The referral programme is open to all Users, subject to the conditions below. Referring Users may receive loyalty points for each new User they refer (hereinafter the “Referee”).
To qualify, the Referee must have taken out a Subscription or created an account on the Site with a House. Only new users may be referred; accordingly, the Referee must not already hold an account on the Site or another Subscription.
Loyalty points scheme for the referring User:
- –the Referee has entered into and paid for an annual Subscription: 600 loyalty points
- –up to a limit of 40 Referees: the Referee has created an Account and completed onboarding: 1 loyalty point
The referring User may accumulate loyalty points without any monthly limit, regardless of the number of successful referrals.
Loyalty points are valid for twelve (12) months from the date on which they are obtained. After this period, the points expire and can no longer be used.
Loyalty points may be converted exclusively into gift cards from the partner illicado according to the following scale:
- –800 loyalty points = €8 in gift card value
- –1500 loyalty points = €15 in gift card value
- –3000 loyalty points = €30 in gift card value
- –4800 loyalty points = €60 in gift card value
- –6000 loyalty points = €75 in gift card value
- –7200 loyalty points = €100 in gift card value
Accumulated loyalty points may be converted into the gift cards available in the “Your referrals” section of the Site.
If the Referrer's accumulated loyalty points fall between the tiers indicated, they may obtain the gift card corresponding to the tier below. Their remaining loyalty points will remain available in their points balance in the “Referral” section of the Site.
Article 9 – PAYMENT TERMS
The User is informed that the Services cannot be made available until the Publisher has received full payment of the sums owed by the Customer.
The Publisher uses the Stripe online payment solution, operated by Stripe Inc.
Through Stripe, orders placed on the Site are paid by payment card.
Subscriptions taken out from the mobile application may also be paid by in-app purchase via the App Store or Google Play. Such payments are then subject to the terms of the platform concerned, which collects the payment.
If the sums due cannot be debited, the order will immediately become null and void.
As part of verification procedures carried out by Stripe, the Publisher may need to ask the User for any documents necessary to finalise their order. These documents will not be used for any other purpose.
Article 10 – PAYMENT OF THE PRICE
The price of the Subscription in force at the time of the order is stated in euros, inclusive of all taxes (TTC).
The price is payable exclusively in euros (€).
The Publisher reserves the right to change the price of each subscription plan, the price applicable to the Customer being the one in force on the date the Subscription is taken out or renewed. The Publisher will inform each Customer of any change in the price of the Subscription at least 15 (fifteen) days before it takes effect, which will be at the next tacit renewal of their annual Subscription.
In such a case, a Customer who does not accept the price increase will be free not to renew their Subscription from their Account as indicated in Article 10 below, such termination taking effect at the next renewal date of their Subscription. Failing this, the new pricing will apply from the next Subscription renewal date following the entry into force of the new pricing.
Promotional codes cannot be combined. They cannot be used on Subscriptions already taken out and may only be used for new Subscriptions.
Article 11 – RIGHT OF WITHDRAWAL
The Customer has a withdrawal period of fourteen (14) calendar days from the date the Subscription order is placed, in accordance with Article L. 221-19 of the French Consumer Code. To exercise this right of withdrawal, the Customer must duly complete the following form: https://www.cazmate.com/withdrawal-form.pdf
Upon receipt, the Publisher will send the Customer an acknowledgement of receipt of their withdrawal request by email.
If the Customer exercises the right of withdrawal, the Publisher undertakes to refund the sums due to the Customer – less the Services already provided, calculated on a pro rata temporis basis – within fourteen (14) days of receiving all the information needed to process the Customer's refund. This refund may be made using the same means of payment as that used by the Customer. Accordingly, a Customer who paid for their order with credit notes / gift vouchers may be refunded in credit notes / gift vouchers, at the Publisher's discretion.
The exercise of the right of withdrawal by the Customer results in the deletion of the Accounts of the Users belonging to their Group.
By accepting these Terms and Conditions, the Customer expressly acknowledges having been informed of the withdrawal procedure.
Article 12 – TERM AND RENEWAL
When taking out a Subscription, the Customer takes out an annual Subscription.
The Subscription is entered into for a fixed term of one (1) year and is tacitly renewed for successive periods of one (1) year, unless terminated by the Customer in accordance with the terms set out in these ToS.
Unless terminated by the Customer under the conditions of Article 12 – ACCOUNT DELETION AND TERMINATION, the Subscription is tacitly renewed. The price in force on the renewal date for the Subscription concerned will be fully applicable to the Customer, provided that the new price has been sent to the Customer under the conditions of Article 9 – PAYMENT OF THE PRICE above.
Trial or introductory offers for one of the Services, of variable duration, may also be offered on the Site, on a temporary basis or otherwise. Unless otherwise stated, such trial or introductory offers will be subject to these ToS and will be limited to a single registration (same email address), regardless of the trial or introductory offer.
Article 13 – ACCOUNT DELETION AND TERMINATION
Each User, including the Founding Administrator of a House, may delete their Account at any time from the “My account” tab. Deletion of the Account is permanent and results in the loss of access to all the Houses to which the User belonged.
13.1. Effects of Account deletion
When the Account is deleted, the Personal Data that identifies the User is anonymised and their upcoming stays are cancelled. The content they have shared within a House (past stays, expenses, notes) is retained there in anonymised form, in order to preserve the history and accounts of the House's other Users.
The Houses to which the User belonged continue to exist for their other Users. Where the User was the Founding Administrator of a House, the provisions of Article 6.1 apply.
Before confirming the deletion, the User is informed of its consequences, in particular of any sums remaining to be settled between Users of a House.
13.2. Leaving a House or being removed from it
Any User, with the exception of the Founding Administrator, may leave a House at any time, whether or not they pay a Subscription for it.
An administrator may remove any User from a House, with the exception of the Founding Administrator. Paying for a House's Subscription does not protect a User from removal. A removed User retains access to the management of their Subscriptions and may cancel them at any time; in the event of cancellation, the House retains access to Premium Features until the end of the period already paid for.
13.3. Subscriptions and termination
An ongoing Subscription does not prevent anyone from leaving a House, removing a User from it, or deleting a House or an Account. These actions do not result in the termination of the Subscription or the cancellation of the related payment obligations: it is up to the Customer to terminate their Subscription if they no longer wish to pay for it, unless expressly provided otherwise.
To terminate their Subscription, the Customer must go to the “Subscriptions” section. For a Subscription paid by payment card, they will be redirected to the Stripe platform; termination will take effect at the end of the current period, provided that notice is sent at least five (5) calendar days before its expiry date, unless otherwise indicated on the Site. For a Subscription taken out by in-app purchase, termination is carried out from the App Store or Google Play settings, in accordance with the terms of the platform concerned.
If these deadlines are not met, the Subscription will be renewed in accordance with Article 12 – Term and Renewal.
Termination does not give rise to any refund of the Subscription price. All sums paid will remain definitively acquired by the Publisher.
Article 14 – SUSPENSION AND/OR EARLY TERMINATION
Without prejudice to any damages that the Publisher may claim, the Publisher reserves the right to suspend a User's access to the Services and/or to terminate the Subscription to the Services automatically (de plein droit), without notice or compensation, in the event of the User's failure to comply with these ToS, and in particular in the event of:
- –Infringement of the intellectual property rights of the Publisher and/or its licensors;
- –
Circumvention or attempted circumvention of the technical protection measures put in place by the Publisher;
The following, in particular, are considered to constitute circumvention, without this list being exhaustive:
- •the creation of several Accounts by the same person in order to avoid paying for a Subscription;
- •the artificial creation or management of several Houses by a set of Users with the aim of improperly benefiting from the limitations applicable to the Free House;
- •any action intended to prevent or distort the application of the pricing model or of the functional restrictions.
- –Provision of false information when creating the Account or using the Services;
- –Total or partial non-payment of the Subscription price;
- –Failure to comply with the laws and regulations in force.
The Publisher draws the Customer's attention to the fact that the Customer cannot rely on a failure by another User (a member of the House) to comply with these ToS in order to contest a suspension or termination. The Customer is solely responsible for the use made of the Services by the people they have invited to join the House.
A User invited to join a House whose access has been suspended or terminated, whether through their own conduct or that of another User, no longer has access to the related Services and may not make any claim or seek any compensation whatsoever from the Publisher.
For their part, the Customer may terminate their Subscription, without notice and without any compensation being due to the Publisher, in the event of a serious breach by the Publisher of its essential obligations as defined in these ToS.
Article 15 – CUSTOMER SERVICE AND SUPPORT
The Customer's requests concerning their Subscription and the Services should be sent to the Publisher:
- –by telephone on 09 83 21 09 66, during the following opening days and hours: 9:00 am – 7:00 pm;
- –by email to contact@cazmate.com, stating their name, telephone number, the subject of their request and/or the number of the order concerned.
In addition, the Publisher provides a support service for Users, accessible:
- –by telephone on 09 83 21 09 66, during the following opening days and hours: 9:00 am – 7:00 pm;
- –by email to contact@cazmate.com, stating their name, telephone number, the subject of their request and/or the number of the order concerned.
Access to support may vary depending on the channel used (Site or application) and on whether there is an active Subscription.
Article 16 – INTELLECTUAL PROPERTY AND LICENCE OF USE
The Publisher is the sole owner of all elements present on the Site, including without limitation all texts, files, animated or still images, photographs, videos, logos, drawings, designs, software, trade marks, visual identity, databases, the structure of the Site and all other intellectual property elements and other data or information (hereinafter the “Elements”), which are protected by French and international laws and regulations relating in particular to intellectual property.
Consequently, none of the Elements of the Site may, in whole or in part, be modified, reproduced, copied, duplicated, sold, resold, transmitted, published, communicated, distributed, disseminated, performed or displayed, stored, used, rented or exploited in any other way, free of charge or for consideration, by a User or by a third party, whatever the means and/or media used, whether known or as yet unknown, without the prior express written authorisation of the Publisher on a case-by-case basis, and the User is solely liable for any unauthorised use and/or exploitation.
Furthermore, it is specified that the Publisher is not the owner of the content posted online by Users, for which Users remain fully responsible and in respect of which they indemnify the Publisher against any claim. Users grant the Publisher a non-exclusive, transferable, sub-licensable, royalty-free, worldwide licence to use the intellectual property content they publish on the Site, for the entire term of protection of such content.
The Publisher reserves the right to take any legal action against persons who have not complied with the prohibitions contained in this article.
Article 17 – LIABILITY
The Publisher declares that it has taken out insurance covering its professional civil liability.
Without prejudice to the cases of exclusion of liability expressly provided for elsewhere herein, the Service Provider may only be held liable in the event of proven fault or negligence, and such liability is limited to direct losses, to the exclusion of any indirect loss of any kind whatsoever (such as loss of earnings, loss of opportunity, expected profits or reputational damage). In this context, the total liability of the Service Provider is limited to the amount of the Subscription during which the event giving rise to the Service Provider's liability occurred.
Furthermore, the Service Provider cannot be held liable in the following cases:
- –non-performance of these ToS due to the User, or due to an event qualified as force majeure by the competent courts, or due to the unforeseeable and insurmountable act of any third party to these ToS;
- –as a result of information imported, stored and/or published on the Site by Users, the User who published it remaining solely responsible in this respect;
- –as a result of any use of the Site and its Services by Users in breach of these ToS and of any direct or indirect damage that such use may cause to a User or to a third party. In particular, the Publisher cannot be held liable for false statements made by a User or for that User's conduct towards other Users or third parties.
- –by reason of the terms and consequences of the User's access to the Site, in particular via the Internet. Such access may involve the payment of fees to technical providers such as, in particular, Internet service providers, which remain payable by the User. In addition, the User shall bear the cost of, and remain fully responsible for, the equipment necessary to connect to the Site.
The User acknowledges having verified that the IT configuration they use is secure and in working order. A mobile Internet connection using third-generation (3G) mobile telephony technology is very strongly recommended.
Article 18 – WARRANTY
The User acknowledges that the characteristics and constraints of the Internet make it impossible to guarantee the security, availability and integrity of data transmissions over the Internet. Accordingly, the Publisher does not guarantee that the Site and its Services will operate without interruption or malfunction. In particular, their operation may be temporarily interrupted for maintenance, updates or technical improvements, or in order to change their content and/or presentation.
The User is solely responsible for all the content they post on the Site, for which they expressly declare that they hold all the rights, and accordingly warrants to the Publisher that they do not post content that infringes the rights of third parties, in particular intellectual property rights, or that constitutes an attack on individuals (in particular defamation, insults, abuse, etc.) or on privacy, or a breach of public order (in particular, glorification of crimes against humanity, incitement to racial hatred, child pornography, etc.). In the event of a breach of the laws in force or of these ToS, the Publisher may automatically exclude Users who are guilty of such infringements and delete information and links to such unlawful content. With regard to content posted online by third parties and/or Users, the Publisher qualifies as a hosting provider within the meaning of Article 6 of French Law of 21 June 2004 on confidence in the digital economy (Loi pour la confiance dans l'économie numérique, “LCEN”). In this respect, it is noted that the Publisher has no general obligation to monitor the content transmitted or stored via the Site. Should the Publisher's liability be sought on account of content posted online by the User, the User undertakes to indemnify the Publisher against any judgment handed down against it and to reimburse the Publisher for all costs, in particular lawyers' fees, incurred in its defence.
Article 19 – PERSONAL DATA
In accordance with Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), the Service Provider carries out personal data processing for the purpose of operating the Site for the benefit of the User and in accordance with these ToS.
The rights and obligations of Users and of the Service Provider with regard to the protection of personal data are defined in the Privacy Charter (the “Charter”). You may consult this Charter on the Site at any time via the following link: Privacy Policy
Article 20 – HYPERLINKS
Hyperlinks available on the Site may lead to third-party websites not published by the Publisher.
The User acknowledges that the Publisher neither controls nor contributes in any way to the drafting of the terms of use and/or content applicable to or appearing on such third-party websites.
Consequently, the Publisher cannot be held liable in any way whatsoever as a result of such hyperlinks.
The Publisher invites the User to report any hyperlink on the Site that gives access to a third-party website offering content contrary to the law and/or to the rights of third parties.
The User may not use and/or insert any hyperlink pointing to the Site without the prior written consent of the Publisher on a case-by-case basis.
Article 21 – COMMERCIAL REFERENCES
A User acting in a professional capacity authorises the Publisher to mention their trade name and logo as a reference in its communication materials (brochure, website, commercial proposal, press relations, press release, press kit, internal communication, etc.).
Article 22 – GENERAL PROVISIONS
These ToS constitute a contract governing the relationship between the Users and the Publisher.
If one or more provisions of these ToS are held to be invalid pursuant to a law or regulation or following a final decision of a competent court, the other provisions shall retain their full force and effect.
Furthermore, the fact that one of the parties to these ToS does not invoke a breach by the other Party of any of the provisions of these ToS shall not be interpreted as a waiver on its part of the right to invoke such a breach in the future.
Subject to the provisions of these ToS, the Publisher reserves the right to modify the content of the Site or of the Services available on it at any time and without notice, and/or to cease operating all or part of the Site temporarily or permanently.
The Customer is therefore required to refer to these ToS before any use of the Site. In the event of material changes to the ToS and/or the Site, the User will be informed by email and by a notice on the Site before the change is applied.
These ToS are governed by, and shall be construed and applied in accordance with, French law.
These ToS are drafted in French. They may be translated into other languages for information purposes only; in the event of any discrepancy, the French version alone shall prevail.
In the event of a dispute arising in connection with their performance, termination or interpretation, the Parties will endeavour to settle their dispute amicably. In this case, the User must send their complaint to the following email address: contact@cazmate.com in order to request an amicable settlement.
In accordance with Articles L.611-1 et seq. of the French Consumer Code, if there is a dispute, you can use the consumer mediator TECHNOMATE belongs to, free of charge: CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, 01 89 47 00 14, www.cm2c.net. Before contacting the mediator, you must first send a written complaint to our customer service (contact@cazmate.com). You can contact the mediator within one year of that complaint.
Cazmate users undertake to provide accurate information and to comply with the laws in force. They must comply with local laws concerning the declaration of income and administrative obligations. Cazmate cannot be held liable for users' failure to comply with these obligations.
By registering on and/or using the Site, the User confirms that they have read and accept the ToS, and are therefore contractually bound by the terms of these ToS.
The ToS applicable to the User are those available on the date of the order, a copy of which, dated as of that date, may be provided to the User upon request; it is therefore specified that any amendment to the ToS made by the Publisher will not apply to any order placed previously, unless expressly agreed by the User who placed the order in question.
